These Terms of Service (“Terms”) govern your use of zachfitness.shop (the “Site”) and any purchase from ZachFitness (“we”, “us”, or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility. You must be at least 18, or the age of majority in your jurisdiction, and able to form a binding contract.
Products and pricing. We work to describe and price products accurately but do not warrant that descriptions, images, specifications, or prices are error-free. All prices are in US dollars and may change without notice. If a product is listed with an incorrect price or specification, we may cancel any order for that product, even after confirmation.
Orders. Your order is an offer to buy. We may accept or decline it and may limit or cancel quantities. An order confirmation does not guarantee acceptance; a contract forms only when we ship. If we cancel after payment, we issue a full refund.
Payment. Payment is due at checkout through our approved providers. By paying, you confirm you are authorised to use the payment method.
Assembly and safe use. Most equipment ships flat-packed for self-assembly. You are responsible for assembling equipment according to the supplied instructions, installing it on a suitable, level surface, observing stated weight capacities, and inspecting hardware periodically. Improper assembly, modification, or use beyond the rated capacity may cause injury and voids the warranty.
Intellectual property. All Site content is owned by or licensed to us and protected by law. You may not copy or reuse it commercially without written permission.
Acceptable use. You agree not to use the Site unlawfully, interfere with its operation, attempt unauthorised access, or submit false information.
Warranties and disclaimers. Products are covered by the warranty stated on the product page or in our Refund & Returns Policy. Except as expressly stated, the Site and products are provided “as is” to the fullest extent permitted by law.
Limitation of liability. To the maximum extent permitted by law, ZachFitness is not liable for indirect, incidental, or consequential damages. Our total liability for any claim will not exceed the amount you paid for the product at issue.
Governing law. These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Disputes will be handled in the courts located in Texas.
Changes. We may update these Terms; continued use after changes are posted is acceptance.
